NOTE: Debtors who knowingly conceal assets from creditors may also be criminally liable under Penal Code sections 154-155. Such a crime is a misdemeanor punishable by jail time up to one year and fines. Individuals who assist debtors in fraudulent transfers may be liable under a theory of criminal conspiracy as well. A recent 9th Circuit decision even endorsed the idea that there might be relief for creditors under "RICO" - the Racketeering Influenced Corrupt Organizations Act - to pursue a cause of action against a person assisting a debtor in fraudulently concealing assets. Smagin v. Yegiazaryan, 37 F.4th 562 (2022).
